Terms and conditions

These terms apply to any website, admin system, or ongoing plan purchased through webdesignbydv.com, between the client and Freelance Davio (Eenmanszaak), KVK 73898058, based at IJburglaan 596, 1087 BT Amsterdam, Netherlands. By engaging these services, the client agrees to these terms.

Three one time website packages are offered:

• The Brand Accelerator, a complete website up to 5 pages with a custom built layout, CMS access, enterprise grade security and hosting, an SEO foundation, and lead capture forms, for €1,950 one time (excl. VAT).
• The Smart Operations Portal, everything in Tier 1 plus up to 10 pages, a basic webshop or reservation system, integrated payments, and a private password protected admin portal, for €2,950 one time (excl. VAT).
• The Complete Digital Backbone, everything in Tier 2 plus unlimited pages, a full webshop and reservation system, employee accounts, customer accounts, and multi language support, for €4,250 one time (excl. VAT).

Monthly plans are available alongside a website built through one of the above packages:

• Self Managed, at no monthly cost. The client receives the complete website and code and arranges their own hosting and future changes. No support, security monitoring, or content updates are included.
• Care, at €79 per month (excl. VAT), including hosting, automated security monitoring, content updates up to 30 minutes per month, and priority response within 24 hours.
• Growth, at €129 per month (excl. VAT), including everything in Care with content update time raised to 60 minutes per month.

Care and Growth have a minimum term of 3 months from the start date, after which they continue month to month and can be cancelled at any time.

All prices shown on this site, including the one time packages and the monthly plans, are stated excluding BTW (Dutch VAT). The business does not apply the kleineondernemersregeling (KOR), so the standard Dutch rate of 21% BTW is added to every invoice.

Payment is required in advance. For the one time website packages, work starts once payment has been received.

The monthly plans Care and Growth are invoiced monthly in advance. The included support time for a given month, 30 minutes for Care and 60 minutes for Growth, becomes available once that month has been paid. Payment is made by bank transfer (SEPA).

One time packages include the build described for that tier. Requests that go beyond the agreed scope, for example additional pages, custom integrations, or a change in the core structure after work has started, are treated as a scope change and quoted separately before work begins. For Care and Growth, only the content update time listed above is included each month; work beyond that time is quoted separately.

The client is responsible for supplying the text, images, logos, and other content needed to build the site, unless otherwise agreed, and for reviewing and approving the site before it goes live. Delays in supplying content or approvals may delay the delivery date accordingly.

Once a one time package is paid in full, the client owns the delivered website and its code, and can move it to their own hosting at any time, as reflected in the Self Managed option. Until full payment is received, ownership remains with the developer. Any underlying frameworks, tools, or reusable components remain the property of their respective owners.

The developer will deliver services with reasonable care and skill, but is not liable for indirect, incidental, or consequential damages, including lost revenue or lost data, except where such liability cannot be excluded under Dutch law. Where the developer is liable, total liability for an engagement is capped at the amount paid by the client for that engagement. This cap does not apply to liability arising from intent or deliberate recklessness (opzet of bewuste roekeloosheid), since Dutch law does not permit excluding or limiting liability for those.

One time packages are considered complete once the agreed scope is delivered and paid for. Care and Growth have a minimum term of 3 months. If the client cancels within that period, the full 3 months remain payable regardless of when the cancellation is given. After the minimum term, the plan continues month to month and can be cancelled with effect from the end of the current billing month.

These terms are governed by the laws of the Netherlands. Any dispute that cannot be resolved directly will be submitted to the competent court in Amsterdam.
